Providing data to NVM/brainbay
Some services also provide data to NVM/brainbay. NVM/brainbay does the following with this data:
- Ensure that all NVM brokers have an up-to-date supply of homes, commercial properties and agricultural real estate that are or will be offered through NVM brokers.
- Ensuring that current listings are posted on funda and other (housing) websites.
- Provide a database through which appraisals and other valuations are possible and insights can be built about developments in the housing market, commercial real estate market and agricultural real estate market. The data in this database is kept indefinitely.

We take your privacy seriously
The NVM broker and NVM/brainbay take your privacy very seriously and regard the rules around data protection as logical standards of decency. The NVM broker processes your data carefully and in accordance with legal requirements. The NVM broker pays great attention to adequate security so that your data is protected against unauthorized use, unauthorized access, modification and unlawful destruction. All NVM brokers continuously invest in providing good service. Part of this is the NVM-wide privacy program. If you have any questions, please do not hesitate to contact the NVM broker.
Viewing, changing or deleting data
If you want to know what information the NVM broker has about you, send your request to the broker by letter or e-mail.
NVM/brainbay does not process names or other directly identifying data. If you would like to know what data NVM/brainbay processes, please also contact the NVM broker who will then ensure that you are informed.
Also, if you want to change or delete the data, please send a reasoned letter or e-mail to the NVM broker. Your request will be complied with as soon as possible, unless the law requires the data to be kept or if there are (other) urgent reasons that oppose modification or deletion.
How can you file a complaint?
If you have any questions or if you have a complaint about the NVM broker's use of data, please contact the NVM broker first. If you are unable to reach an agreement with the NVM broker, please contact the NVM complaint coordinator at: klachtencoordinator@nvm.nl. In that situation, the NVM Data Processing Officer may also consider the complaint. You also have the right to file a complaint with the Authority for Personal Data.
How long does the NVM broker keep the data?
The NVM broker does not retain data longer than necessary. However, some data the NVM broker keeps for a long time:
- Some records of service are kept by the NVM broker for 20 years, as the NVM broker can be held liable for professional misconduct during this period.
- The burden of proof that the NVM broker has carried out the mandatory test under the Money Laundering and Terrorist Financing Act (Wwft), the NVM broker keeps 5 years.

The purpose of this contact is to promote your home on your behalf, understand the value of and interest in your home, arrange viewings and negotiate on your behalf and supervise the transaction. - Provide a database allowing for appraisals and other valuations and building insights on developments in the residential, commercial real estate and agricultural real estate markets.
A Current supply of residential, commercial and agricultural properties from NVM brokers
If you wish to sell/lease a home, commercial property or agricultural property through an NVM broker, the following information will be disclosed to other NVM brokers:
- The address of the residential, commercial or agricultural property, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, date the property is taken off the market. Conditional sale, date of sale and transaction price.
This data is used by NVM brokers to provide services to their customers (seekers for a home, commercial property or agricultural property).
This data is kept indefinitely in connection with the database of historical offerings, see under C.
B Current supply of residential, commercial and agricultural properties on (housing) websites, including Funda
If you want to sell/rent a house, a business property or agricultural property through an NVM broker, in consultation with you they can also disclose data to Funda and other (housing) websites. This involves the following data:
- The address of the residential, commercial or agricultural property, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, sale date.
This data is used to bring your property to the attention of consumers, professional parties and/or third parties who themselves search via (housing) websites.
This information may still be visible on these websites for up to one year after the date of sale or the date a home, commercial or agricultural property is taken off the market.
C Database of historical offerings
The following information is recorded in the NVM database of all homes, commercial properties and agricultural real estate offered for sale or rent through an NVM broker:
- The address of the residential, commercial or agricultural property, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, cadastral data, WOZ value and photos of the property.
- Date the property goes on the market, date the property is taken off the market. Conditional sale, transaction date and transaction price.
- The postal code (1234AB) and house number of the buyer's previous (residential) address. The aforementioned data will be kept indefinitely.
With the aforementioned data, brainbay facilitates analyses of the real estate market on behalf of the NVM.
NVM/brainbay further provides this data to selected third parties, namely:
- NVM Appraisers, for doing appraisals and other valuations.
- Validation institutes, after being explicitly instructed to do so by an NVM appraiser, to check appraisal reports.
- Municipalities, for determining WOZ values.
- Ministry of Infrastructure and Water Management, for housing market research.
- Universities, for research purposes.
- NVM brokers in the course of providing services to their clients.
- Non NVM brokers, banks, property developers and housing associations, for research purposes (e.g. housing needs in a particular region).
These parties only have access to data for the stated purposes and, where possible, data is provided only at an aggregate level.
Internal audits and investigations
The NVM may view your data when it conducts research among its members to determine whether the rules are being complied with and when the NVM conducts an audit of an NVM member. After inspection, these data will no longer be processed by the NVM.
Viewing, changing or deleting data
If you wish to view, change or delete data processed at NVM/brainbay please contact NVM at privacyhelpdesk@nvm.nl. NVM will assess whether you are entitled to make the request and then whether your request will be granted.
